This petition has been filed with a prayer to direct the respondents to release the amount pursuant to policy availed by petitioner's wife bearing Policy No. 0239220907 for a sum of Rs. 30 Lacs by Tata AIG General Insurance Company Ltd. Learned State Counsel has obtained instructions, according to which, the mother of the deceased was the nominee in the insurance policy and that the amount due under the policy has been credited to her account. The bank statement, in that regard, has been placed along with the instructions, which are taken on record. Learned counsel for the petitioner submits that such amount should not have been paid to the mother, since his application to change of nominee was made. It remains undisputed that at the time of death of the policy holder, the nominee was the mother. Such amount due under the insurance policy, once has been credited to the account of the nominee, no exception can be taken to it by this Court. For any dispute between the husband of the deceased and other family members, remedy would be to approach the competent Civil Court. The writ petition is, accordingly, dismissed.
