ORDER 15.10.2025
01. The petitioner came to be awarded compensation amount of Rs. 20.00 lacs by the writ court in terms of its judgment dated 22.07.2024 which had attained finality when LPA No. 314/2024 came to be dismissed by the Division Bench in terms of its order dated 03.01.2025.
02. The petitioner came forward with the present contempt petition seeking deposit of the compensation amount which led to the passing of repeated directions from this Court upon the
contemnors/respondents for deposit of the compensation amount of Rs. 20.00 lacs.
03. In compliance to the direction as given in
order dated 19.09.2025, requisite deposit of Rs. 20.00 lacs has come to be made accordingly on
13.10.2025. The amount is meant for payment in favour of the petitioner.

Mr. Faheem Nisar Shah, learned Government Advocate submits that since there is a Special Leave Petition (SLP) preferred before the Hon’ble Supreme Court of India in which notice has been issued to the writ petitioner, as such, the release of the compensation amount to whatsoever extent be kept subject to the outcome of the Special Leave Petition (SLP).

Keeping in view this plea, this Court directs release of an amount of Rs. 10.00 lacs in favour of the petitioner through bank mode transfer to be done by the learned Registrar Judicial, Srinagar, subject to the furnishing of an undertaking by the petitioner that the release of the amount availed by him shall always remain subject to the outcome of the Special Leave Petition (SLP).
06. The rest of the amount of Rs. 10.00 lacs be kept in a fixed deposit by the Registrar Judicial, Srinagar, initially for a period of three months and thereafter extendable till to any order to the contrary.
07. CM No. 6746/2025 seeking release of the amount is accordingly disposed of.
08. List the main case on 10.11.2025.
