No.400 of 2025 O R D E R This petition is filed under Sections 3, 7 to 10 and 25 of the Guardian and Wards Act, 1890 and Order XXI Rule 2 & 3 for appointment of Guardian and Clause XVII of the Letters Patent Act, 1865, praying to declare the petitioner herein as the Guardian of the minor child, namely Abigail Fiona Grace Abhisek, who was born on 23.03.2016, aged about 9 years old and to direct the respondent to handover the custody of the minor child, namely Abigail Fiona Grace Abhisek to the petitioner.
2. This Court, referred the matter to the Mediation Centre, vide its
order dated 07.04.2026. The mediation report, dated 01.06.2026 was received by this Court, wherein it has been stated that “No agreement was reached between the parties”. Subsequently, the case was listed before this Court on 31.07.2026, whereby this Court directed the parties to be present before this Court on 12.08.2026.
3. When the case was listed on 12.08.2026, the learned counsel for the petitioner filed a memo, seeking permission of this Court for conducting in- camera hearing. Accordingly, in-camera hearing was conducted between both the parties alongwith their respective counsels. Upon conclusion of the same, __________ Page No.2 of 4 https://www.mhc.tn.gov.in/judis
O.P. No.400 of 2025 both sides requested time to place a joint parenting plan before this Court. Considering the request made by both sides, this Court granted time to place the joint parenting plan and directed the Registry to list the matter on
19.08.2026.
4. Today, when the matter is taken up for hearing, the learned counsels appearing on either sides jointly presented the Parenting Plan, entered between the divorced Spouses, for their minor daughter, by mutual Consent comprising 24 clauses, duly signed by both the parties and their respective counsels.
5. In view of filing of the Parenting Plan by mutual consent before this Court, after arriving at an amicable settlement between the parties, this Original Petition is disposed of in terms of the above Joint Parenting Plan, dated 19.08.2026. The terms mentioned in the Joint Parenting Plan, shall form part and parcel of this order.
