P.P. --- 04/13.06.2025 Heard Mr. Abhishek Singh, learned counsel for the appellant and Mrs. Nehala Sharmin, learned Spl. P.P. This appeal is directed against the order dated 25.02.2025 passed by the learned Additional Sessions Judge- III, Jamtara in Misc. Criminal Application No. 68/2025 in connection with Bagdehari P.S. Case No. 19/2022, whereby and whereunder, the prayer for bail of the appellant has been rejected. The allegation reveals that an attempt to commit dacoity was made in the house of the informant and when, on alarm, the villagers had assembled, the dacoits had fled away by hurling bombs. Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on the disclosure made by the co-accused Ashraf Ali Khan alias Asaraf Ali Khan, who has already been granted bail by this Court in Cr. Appeal (DB) No. 1304 of 2023. It has been submitted that the appellant had voluntarily surrendered on 17.01.2025 and since then he is in judicial custody. Mrs. Nehala Sharmin, learned Spl. P.P. has opposed the prayer for bail of the appellant. Neutral Citation No. ( 2025:JHHC:15342-DB ) -2- Regard being had to the manner of implication of the appellant and the fact that one of the co-accused has been granted bail by this Court as noted above, we while setting aside the order dated 25.02.2025 passed by the learned Additional Sessions Judge-III, Jamtara in Misc. Criminal Application No. 68/2025 in connection with Bagdehari P.S. Case No. 19/2022, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Principal Sessions Judge, Jamtara in connection with Bagdehari P.S.
