Neutral Citation No. - 2025:AHC:21604 Court No. - 37 Case :- WRIT - C No. - 30614 of 2024 Petitioner :- Bhagwan Singh Respondent :- State Of Up And 4 Others Counsel for Petitioner :- Anoop Kumar Mishra Counsel for Respondent :- C.S.C.,Krishna Kant Singh Hon'ble Kshitij Shailendra,J.
1. Heard Ms. Soni Gupta, Advocate holding brief of Sri Anoop Kumar Mishra for the petitioner, learned Standing Counsel for the State respondent and Sri Krishna Kant Singh for the respondent Gaon Sabha.
2. The last order under challenge in the present petition is dated 31.05.2016, by which Revision No. 83/C2016180000327 preferred by the petitioner was dismissed by the Additional Commissioner (Judicial) Aligarh Region, Aligarh.
3. The order dated 31.05.2016 has been challenged after a period of eight years.
4. Though learned counsel for the petitioner has vehemently argued that the order impugned is illegal and is liable to be set aside, when this Court asked learned counsel to explain the inordinate laches of eight years, except by referring to paragraph no. 21 of the writ petition, nothing substantial was argued.
5. The Court has perused the paragraph 21 of the writ petition in which statement has been made that the order dated 31.05.2016 was not in petitioner's knowledge as he was not informed by his counsel and, thereafter, during the Covid period, the petitioner failed to visit his counsel.
6. This Court is not inclined to accept the bald statement made in paragraph no. 21 of the petition. Covid period began in March, 2020 and is over about three years ago and there is no explanation as to why from 2016 till 2020 or after 2022, the order impugned was not assailed. This Court cannot help a litigant who sleeps over his rights and legal maxim Vigilantibus, et non dormientibus, jura sub venlunt (the law helps those who are watchful and not those who seep over their rights) applies in full force against the
petitioner.
7. In view of the inordinate laches and lack of digestible explanation, this Court is not inclined to entertain the petition after eight years.
8. The writ petition, being highly barred by laches, is, accordingly, dismissed. Order Date :- 14.2.2025 Pkb/ Digitally signed by :- PRAMOD KUMAR BAJPAI High Court of Judicature at Allahabad
