2/15.04.2025 Heard the parties. The petitioner has been made accused in connection with POCSO Case No.120 of 2024, arising out of Daltonganj Town P.S. Case No.393 of 2024, registered for the offences punishable under sections 65(2) of the BNS and Section 4 of the POCSO Act. It is submitted by the learned counsel for the petitioner that the allegation against the petitioner is that the petitioner has committed penetrative sexual assault upon the minor victim girl of 11 years. It is submitted that the allegation against the petitioner is false. It is next submitted that the petitioner has been in custody since 30.10.2024 and charge-sheet has been submitted against him. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. vehemently opposes the prayer for bail by submitting that there is direct and specific allegation against the petitioner of committing penetrative sexual assault upon the minor victim girl and same was seen by the informant and prior to that also, three times, petitioner committed the same offence with the minor victim girl. It is next submitted that there is every chance of the petitioner absconding and tampering with the evidence, if he is released on bail. Hence, it is submitted that the petitioner ought not be admitted to bail. Considering the serious nature of allegation against the petitioner and the chance of his absconding as well as his tampering with the evidence, if released on bail, this Court is of the considered view that this is not a fit case, where the above-named petitioner be released on bail. Accordingly, the prayer for bail of the above-named petitioner is rejected. (Anil Kumar Choudhary, J.) R.Kumar
