This writ petition has been filed with the following prayer:- "I)A writ order or direction in the nature of mandamus commanding and directing the Respondent no. 2 (Sub Divisional Magistrate, Tehsil Tamkuhiraj, District-Kushinagar) to consider and decide the Restoration Application dated 10.02.2023 file by Respondents No. 19 for recalling the order dated 21.10.2021 Passed in Case No. 7509 of 2021 Computerized case No. T-202105440307509 (Dwarika Versus Munni Lal and others) under section 24 of U.P. Revenue Code 2006 within stipulated period which is pending since 10.02.2023." 2. It is contended that restoration application is pending in proceedings under Section 24 of the U.P. Revenue Code, 2006. Learned counsel for the petitioner submits that the said restoration application may be decided expeditiously. 3. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit, the matter is being disposed of, at the admission stage, with a direction upon respondent no.2- Sub Divisional Magistrate, Tehsil- Tamkuhiraj, District- Kushinagar to decide the restoration application dated 10.02.2023 pending in proceedings under Section 24 of the U.P. Revenue Code, 2006, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of one month from the date of production of certified copy of this order. 4.
