Case No. 916 of 2019 dated 26/10/2019 under Sections 302/201/120B/34 of the Indian Penal Code, 1860 corresponding to GR 6212 of 2019 pending before the Court of the Learned Additional Chief Judicial Magistrate at Barrackpore. Mr. Neguive Ahmed, Ld APP Ms. Ayantika Ray …for the State. Mr. Partha Sarathi Das … for the de facto complainant. Petitioner seeks bail. Learned Advocate appearing for the petitioner submits that the petitioner is in custody for 96 days. The police submitted charge sheet. Another co-accused standing on the same footing was granted bail by the coordinate Bench on March 2, 2020 in C.R.M.2204 of 2020. Learned Additional Public Prosecutor draws the attention of the Court to the materials in the case diary and the statements recorded under Section 164 of the Code of Criminal Procedure. Learned Advocate appearing for the de facto complainant submits that the petitioner is the main assailant. Considering the fact that the petitioner is named in the statements recorded under Section 164 of the Code of Criminal 2 Procedure along with Shibu Yadav who was granted bail by the coordinate Bench on March 2, 2020 in C.R.M. 2204 of 2020, we grant bail to the petitioner. Accordingly, we direct that the petitioner shall be released on bail upon furnishing a Bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Learned Additional Chief Judicial Magistrate, Barrackpore, North 24-Parganas, subject to the conditions that the petitioner shall not enter the jurisdiction of North 24-Parganas until further orders except for attending court proceedings and shall provide the address where he shall presently reside to the investigating agency and the court below. He shall report to the officer-in-charge of the concerned police station within whose jurisdiction he shall presently reside once in a week until further orders. He shall appear before the trial court on every date of hearing until further orders and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever. In the event the petitioner fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
