The aforesaid first appeal was filed by the plaintiff-appellant against the judgment dated 26.5.1993, passed by the IX Additional District Judge, Bareilly in Original Suit No. 56 of 1977; between Avnish Agarwal Vs. Rameshwar Nath. 2. When the matter was listed on 22.9.2022, office was directed to issue notice to the appellant to engage another counsel. 3. Office report is that the notice was issued to the sole appellant through registered post fixing 25.11.2022. Office report of 10.4.2025 is that the undelivered cover that was sent to the sole appellant has been returned with the remark that it was informed at the stated address that the recipient has died and, therefore, the registered cover was returned. As per report, no substitution application has been filed. 4. In view of the aforesaid, the appeal abates and let it be consigned to record. 5. The trial court record, if any be returned within fifteen days to the concerned court.
