The application was rejected vide order dated 23rd June, 2025 made by respondent no.2 (the District Magistrate). He submits, pendency of criminal case cannot be reason for the rejection. Sri Ashim Mukherjee, learned advocate, Standing Counsel appears on behalf of State and on query submits, to best of his knowledge, view taken by the Lucknow Bench on 28th May, 2024 in, inter alia, Writ C no. 798 of 2024 (Anil Kumar Vs. State of U.P. and 3 Others) has not been interfered with. In circumstances aforesaid, impugned order dated 23rd June, 2025 is set aside and the application restored to respondent no.2. Said respondent will issue the certificate pursuant to Anil Kumar (supra). Petitioner will communicate certified copy of this order along with copy of his application dated 25th March, 2025 to respondent no.2. Action be taken within three weeks of the communication.
