This is an application under Section 151 CPC read with Article 226 of the Constitution of India for recalling the order dated 11.10.2023 passed by this Court. 2. Learned counsel for the applicant has submitted that inadvertently in the writ petition as well as in the legal notice issued by the petitioner, the applicant-petitioner had mentioned wrong bus number i.e., bus no.PB-05B-9528 whereas the bus in question regarding which the case was filed was PB-05B-9526. It is submitted that although this Court had disposed of the writ petition by directing respondent no.2 to decide the legal Davinder Kumar 2025.09.10 17:15 I attest the accuracy and authenticity of this order / judgment CWP-22974-2023(O&M) 2 notice but in view of the abovesaid mistake, it is prayed that the said order dated 11.10.2023 be recalled and the petitioner be permitted to file a fresh writ petition, after withdrawing the main writ petition, after giving full and better particulars and after correcting the mistake made. 3. Keeping in view the above said facts and circumstances, the application is allowed and the order dated 11.10.2023 is recalled and the main case is taken on Board. CWP-22974-2023 1. This is a Civil Writ Petition filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing respondent No.2 to decide the legal notice of the petitioner served upon him through registered post dated 18.08.2023 (Annexure P-1) whereby the petitioner has prayed for deletion of his bus No.PB-05B-9528 from the permit as it has been sold and to further enable the petitioner to get the permit renewed. 2. Learned counsel for the petitioner has submitted that inadvertently in the head note as well as in the main case, the bus number has been wrongly mentioned as PB-05B-9528 instead of PB-05B-9526 and thus, the petitioner be permitted to withdraw the present petition with liberty to file a fresh petition after giving full and better particulars and after correcting the mistake made in the writ petition and in the legal notice. 3.
