1. This is the second bail application filed by the applicant. The first bail application of the applicant has been dismissed as withdrawn vide

2 to the applicant to repeat his prayer for bail after examination of material witnesses.

Learned counsel for the applicant would submit that total 6 witnesses have been examined out of 16 witnesses, they are the material witnesses, therefore, he has filed the second bail application as the conclusion of trial of the case will take its own time.
3. On the other hand, learned counsel for the State opposes.

From perusal of the document annexed with the present bail application it appears that the first bail application of the applicant has been dismissed as withdrawn vide order dated 20.11.2024 and on the same day i.e. on 20.11.2024, the mother of the victim PW-1 as well as victim PW-2 have been examined before the learned trial Court and no other documents of any other witnesses have been annexed in the present bail application. Even otherwise, there is no material placed on record as to who are the material witnesses and who are yet to be examined before the learned trial Court. Therefore, I am not inclined to consider that there is change in circumstances or material witnesses are examined.
