PUBLIC PROSECUTOR The Court made the following: ORDER:I This Criminal Petition, l]nder Sections 480 and 483 of the BNSS, has been filed by the petitioner/A1, seeking regular bail, in crime No.2 of 2025 of Adoni ll Town PoI'lce Station, Kurnool District. / *an r _® 2 2. A case has been registered against the petitioner herein and others for the offences punishable under Sections 318(4), 336(4), 338, 340(2), 342(2), 319(2)m 61(2) r/w 3(5) of BNS. 3. The brief facts of the case are that the incident occurred on 31.12.2024 at the Sub-Registrar Office, Adoni Town, and was reported at the police station on 04.01.2025 at 17.00 hours. The complainant, who owns Ac.6.51 cents of land in Sy.No.321/A in Mandigiri, Adoni Town, verified the EC (Encumbrance Certificate) on 04.01.2025 and noticed that the aforementioned land was registered under a General Power of Attorney (GPA) in the name of A2 by A1, who personated as the son of the complainant. Subsequently, Al to A6 cheated the complainant by creating forged documents, including a death certificate, family members' certificate, and signatures of the complainant, which were then registered in the name of A2 by Al with the intention of acquiring the property and defrauding the complainant. 4. Heard. Perused the record. 5. Learned counsel for the petitioner submits that the petitioner has been in judicial GL_lSttedy Since 17.01.2025, and most of the investigation has been completed, with all other / -`--I 6--fu-a 3 accused having beerf released on bail. The learned counsel further submits that the petitioner has a permanent abode at Nandyal Town, and there is no possibility of his fleeing away from the Jurisdiction of the Court. 6. The learned Assistant. Public Prosecutor submits that L.Ws.1 to 19 have been examined, and it appears that most of the investigation has been completed and when ascertained the learned Assistant Public Prosecutor confirmed that the petitioner has no previous antecedents as per his instructions. 7. ln view of the facts and circumstances of the case, since the most of the investigation has been completed and all other accused in this case have already been released on bail, this Court is of the opinion that releasing the present petitioner would not hinder the investigation in anyway. The petl'tioner has been judicial custody since 17.01.2025. Most of the witnesses have been examined by the investigating agency and the release of the petitioner/Al would not cause hampering of investigation, this Court is inclined to grant bail to the petitioner herein/A1, on the following conditions: (i) The petitioner/Al shall be released on executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) e=-EZ=,j5=P\ 4 with two sureties for a like sum each to the satisfaction of the learned I Additional Judicial Magistrate of First Class, Adoni. (ii) After release, the petitioner shall appear before the Station House Officer concerned, once in a week for a period of three (03) months. (iii) That the petitioner is directed not to hamper the investigation and tamper with the prosecution witnesses and he shall cooperate with the investigation. 8.
