Order 07/04/2025
1. The review petition has been preferred by the petitioner for recalling the order dated 18.02.2025 passed by this Court while deciding S.B. Civil Writ Petition No.6640/2019.
2.
Learned counsel for the review petitioner submits that while passing the aforesaid order, the instant writ petition was disposed of granting liberty to the petitioner to file statutory appeal under Rule 23 of the Rajasthan Civil Services (Classification, Control and Appeal) Rules 1958 (for short, ‘the Rules of 1958’) against the
(2 of 2) [WRW-72/2025] impugned order dated 25.02.2019 passed by the respondents.
Learned counsel submits that the aforesaid order passed by the respondents in exercise of its powers contained under Rule 19 of the Rules of 1958 and this order is not appealable under Rule 23 of the Rules of 1958, hence the instant writ petition is maintainable and the same is liable to be decided and adjudicated on its merits.
3. Considering the above factual aspect of the matter, the order dated 18.02.2025 passed by this Court stands recalled. Accordingly, the writ petition is allowed and S.B. Civil Writ Petition No.6640/2019 is restored to its original number. Office to proceed.
