Direct the learned R.C. & E.O./ Additional City Magistrate, 3rd Kanpur Nagar to decide the Case No.7466 of 2025 (Old Case No.09/ 2014) Mohd. Arif vs. Inayat Ullah" arising out of Section 12 (1) r/w Section 16 (1) (b) of the U.P. Act No.13 of 1972, within the stipulated period may be fixed by this Hon'ble Court." 3. Learned counsel for the petitioner submitted that the aforementioned proceeding under Section 12 (1) read with Section 16 (1) (b) of the U.P. Act No.13 of 1972 is pending before R.C. & E.O./Additional City Magistrate, 3rd Kanpur Nagar. He further placed certified copy of the order sheet, which has been annexed as Annexure No.7 to the writ petition in order to demonstrate that the case is not proceeding expeditiously. 4. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally directing Versus Counsel for Petitioner(s) : Manish Tandon Counsel for Respondent(s) : Siraj Ahmad And Another .....Petitioner(s) Inayat Ullah @ Naushe And 2 Others .....Respondent(s) R.C. & E.O./Additional City Magistrate, 3rd Kanpur Nagar to decide the aforementioned Case No.7466 of 2025 (Old Case No.09/ 2014) (Mohd. Arif vs. Inayat Ullah) arising out of Section 12 (1) r/w Section 16 (1) (b) of the U.P. Act No.13 of 1972 in accordance with law expeditiously and preferably within a period of two months from the date of production of certified copy of this order after giving opportunity of hearing to both the parties.
