The present petition has been filed by the petitioners under Section 528 of BNSS for quashing of Complaint No. COMI 51 of 2019 dated 26.11.2019 under Sections 148, 149, 193, 200, 211, 212, 323, 325, 307, 452, 506 and 120-B of IPC titled as ‘Sulochna Devi vs. Vijay Kumar and others’ and summoning order dated 02.04.2025 (Annexure P-3) whereby the petitioners have been summoned under Sections 148/323/324/452/506 read with Section 149 of IPC and all other subsequent proceedings.

Perusal of impugned order reveals that the learned trial Court has passed the order after appreciating the evidence available on the record which was led by the complainant including a doctor who was examined as CW4. The impugned order passed by learned trial Court is well justified and the same does not call for any interference. However, the petitioners are at liberty to exhaust their legal remedy available to them.
