.2025 Heard Mr. H. Das, learned counsel for the applicant. Also heard Mr. J.K. Goswami, learned Addl. Senior Government Advocate for the State respondents and Mr. C. Buragohain, learned Standing Counsel, Water Resources. This interlocutory application has been filed by the applicant who has filed WP(C) No. 5034/2023 praying for direction for consideration of his case for appointment on compassionate ground under the Water Resources Department. The learned counsel for the applicant submits that by oversight the respondent No.1 was shown to be the State of Assam represented by the Commissioner and Secretary to the Government of Assam, Health and Family Welfare Department, Assam, Dispur, Guwahati-6 whereas the appropriate department that ought to have been arrayed is the Commissioner and Secretary to the Government of Assam, Water Resource Department, Assam, Dispur, Guwahati-6. He submits that the said error crept in inadvertently and it was not noticed until the order dated 01.09.2023 passed. As such steps for correction is required to be taken. Accordingly, this interlocutory application has been filed seeking liberty to correct the array of parties more particularly the respondent No.1 in the cause title of WP(C) No. 5034/2023. The learned counsel for the respondents have not objected to the prayer made. Page No.# 3/3 Considering the submissions made by the learned counsel for the parties, this Court is of the view that this Interlocutory Application can be disposed of at this stage without issuing notice. Accordingly, the interlocutory application stands allowed.
The respondent No.1 arrayed as party respondent in WP(C) No. 5034/2023 will be read as the State of Assam represented by the Commissioner and Secretary to the Government of Assam, Water Resource Department, Assam, Dispur, Guwahati-6 instead of the State of Assam represented by the Commissioner and Secretary to the Government of Assam, Health and Family Welfare Department, Assam, Dispur, Guwahati-6. Let the petitioner file amended cause title before the Registry within a period of two weeks from today. This order passed today in interlocutory application shall be read together with the order dated 01.09.2023 passed in WP(C) No. 5034/2023. Copy of this order be retained in the case record of WP(C) No. 5034/2023. This interlocutory application accordingly stands allowed and disposed of. JUDGE Comparing Assistant
