HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 13413 of 2025 Chief Justice's Court HON'BLE ARUN BHANSALI, CHIEF JUSTICE HON'BLE KSHITIJ SHAILENDRA, J.
1. This petition is directed against order dated 20.02.2024 passed by Central Administrative Tribunal, Allahabad Bench, Allahabad ('the Tribunal') in Original Application No. 1486 of 2017 whereby the Original Application filed by the petitioner has been dismissed. 2. The Original Application was filed questioning the validity of order dated 08.09.2017 passed by the respondents whereby the representation made by the petitioner in relation to his educational qualification, pursuant to order passed by the Tribunal in Original Application No. 837 of 2017, was rejected. 3. The petitioner had applied for the post of Assistant Loco Pilot pursuant to Centralised Employment Notice No. 1 of 2014. After undergoing the requisite tests, the petitioner was not accorded appointment as the respondents indicated that the petitioner was not eligible on account of not having the minimum educational qualification. Feeling aggrieved, Original Application was filed whereby the petitioner was required to make a representation and the representation was made, the same was rejected. 4. The Tribunal, after hearing the parties, came to the conclusion that the minimum educational qualification required that the candidate must have the qualification which was recognised by AICTE or NCVT or SCVT, whereas the certificate course undertaken by the petitioner i.e. three years full time AME training course was not approved by either AICTE or Versus Counsel for Petitioner(s) : Vimal Chandra Mishra, Kalp Raj Singh Counsel for Respondent(s) : A.S.G.I., Gopal Verma Akash Shukla .....Petitioner(s) Union of India and 3 others .....Respondent(s)
NCVT or SCVT, consequently the petitioner was not eligible and dismissed the Original Application. 5. Counsel for the petitioner attempted to make submissions that the qualification acquired by the petitioner was much higher than the required qualification and as the petitioner was permitted to appear in the recruitment, the respondents cannot, based on the alleged deficiency in the qualification, deny appointment to the petitioner. 6. We have considered the submissions made and have perused the material available on record. 7. The educational qualification as indicated in the Centralised Employment Notice is very specific, wherein the candidate was required to have Apprenticeship/ITI approved by NCVT or SCVT in various trades indicated therein or Diploma in Mechanical/ Electrical/ Electronics/ Automobile Engineering recognised by AICTE in lieu of ITI.
Further, by Note, it was indicated that candidates having higher educational qualification in Mechanical/ Electrical/ Electronics/ Automobile Engineering recognised by AICTE are also eligible. The certificate produced by the petitioner (page 74 of the paper book) indicates that he has completed three years full time AME training course duly approved by the Director General of Civil Aviation, Government of India. The certificate, nowhere indicates that the said training course was either approved by AICTE or NCVT or SCVT, as required by the advertisement. 8. Despite the fact that the Tribunal clearly held that the said course was not recognised by AICTE or NCVT or SCVT, no material has been produced in the writ petition to negate the said finding, which establishes the said deficiency in the training course of the petitioner. 9. In view thereof, as the petitioner has failed to indicate the minimum educational qualification as required by the Centralised Employment Notice, the action of the respondents cannot be faulted. 10. So far as the plea raised regarding respondents permitting the petitioner to participate in the recruitment is concerned, the said action of WRIA No. 13413 of 2025 2
the respondents cannot act as estoppel in relation to the required educational qualification. 11. Consequently, no case for interference is made in the petition, the same is therefore, dismissed.
