JUSTICE SAMEER JAIN Judgment 28/03/2025 Learned counsel for the petitioner has submitted that the present petition is filed assailing the impugned memorandum of charges dated 11.01.2025 issued by the respondents which is issued after approximately 9 months of filing of charge sheet. It is further submitted that the petitioner is currently in custody, which is rendering it practically impossible for the petitioner to appear in the departmental proceedings initiated against him, which would result in violation of the principles of natural justice, as the principle of Audi alteram partem won’t be complied with, therefore it is prayed that the opportunity to [2025:RJ-JP:14407] (2 of 2) [CW-3206/2025] appear via VC before the disciplinary authority be granted to the petitioner. Learned counsel for the respondent has opposed the said prayer of the learned counsel for the petitioner. Considering the foregoing facts and circumstances of the case, this Court, in the interest of justice, hereby directs the respondents to permit an advocate/ representative authority to appear on behalf of the petitioner to put forth the petitioners’ case. Accordingly, the instant petition is disposed of with the afore mentioned direction. Pending application(s), if any, shall stand disposed of. (SAMEER JAIN),J DIKSHA MISHRA /351
