ORDER 05.02.2025 A civil suit filed by petitioners was decreed on a compromise entered into between plaintiff and defendant as is submitted by learned counsel for petitioner, Mr. P. S. Ahmad. According to Mr. Shafiq, counsel for petitioner, after suit was decreed, execution proceedings were initiated. Execution was, however, objected as an application was filed by respondents herein, wherein they claimed interest in the property with a further plea that they were not the party to the proceedings and the decree was obtained by parties to the suit without knowledge of respondents. The Trial court on respondents’ application stayed execution proceedings. As said by Mr. Shafiq, application made by respondents is required to be decided.
Learned counsel for petitioners lastly submits that petitioners would be satisfied if Trial court is directed to proceed with the proceedings initiated before it by aggrieved party in execution proceedings initiated by petitioners expeditiously. In view of the submissions made by learned counsel for the petitioners, this petition shall stand disposed of without interfering in the order of the Trial court, with a direction to the Trial court to decide the proceedings pending before it expeditiously after hearing the parties. In view of the disposal of the petition, the contempt petition bearing CCP(S) no. 556/2023, does not survive and is accordingly, closed.
