The instant application has been filed with a prayer to recall the order/NBW dated 21.8.2025 passed by Additional District Judge/Special Judge-2, (Prevention of Corruption Act), Meerut in Case No. 246 of 2016 (State Vs. Mool Charan and others) arising out of case crime No. 1005 of 2014 under section 7/13 (1) D Prevention of Corruption Act and Sections 420, 467, 468, 471, 120B IPC, Police Station Sadabad, District Hathras pending in the court of Additional District Judge/Special Judge-2 (Prevention of Corruption Act), Meerut. 3. At the very outset, learned counsel for the applicant submitted that there is defect in the instant application and therefore, the same may be dismissed as withdrawn with liberty to file a better fresh. 4. Learned counsel for the CBI is having no objection to the same. 5. In view thereof, the instant application stands dismissed as withdrawn with liberty as prayed. 6. Office is directed to return the certified copy, if any, to the counsel for applicant after retaining the photocopy of the same on record.
