This writ petition has been filed seeking following relief :- "Issue an order commanding and directing the Civil Judge, (S.D.), West Banda to decide the application filed by respondent no. 1 under order 39 rule 1 and 2 C.P.C. (paper no.6 C) in original suit No.230/2013 (Bahorilal and others Vs Laxminarayan and others) pending in the court of Civil Judge, (S.D.), Banda as well as decide the original suit No.230/2013 (Bahorilal and others Vs Laxminarayan and others) pending in the court of Civil Judge, (S.D.), Banda." 3. Learned counsel for the petitioner submitted that the above-mentioned application (paper No.6C) is pending consideration since 2013 and the same has not been decided till date. Learned counsel prayed that the same may be decided, expeditiously. 4. Since the above-mentioned application is pending, no useful purpose would be served in keeping this petition pending.
