Alam, learned counsel for the petitioners as well as Mr. M.P. Goswami, learned Additional Public Prosecutor, Assam. Pursuant to the interim order dated 18.03.2025 passed by this court, the petitioners have appeared before the Investigating Officer and their statements have already been recorded. The learned Additional Public Prosecutor, Assam has expressed his objection on the ground that petitioners are the persons, who fraudulently created sale deeds in the name of deceased persons. I have considered the submissions made by the learned counsel for both the sides. Since the petitioners have been cooperating with the investigation of the case, this court is of the opinion that their custodial interrogation is not necessary. Hence, the prayer for pre-arrest bail of the petitioners is allowed on that ground only. Accordingly, the interim order dated 18.03.2025 is made absolute. The bail application is disposed of.
