On 24.01.2023, a Coordinate Bench of this Court had although dismissed the writ petition but had given certain directions, the relevant of which is reproduced hereinbelow:- “Consequently, both the writ petitions stand dismissed. Even though this Court has held that writ petitions are not maintainable, however, to do justice and equity between the parties, the respondent-University is directed to issue experience certificates to the members of the petitioner Association, who have worked with the University for a considerable length of time, entitling them to seek employment elsewhere. Necessary application/representation would be made within a period of two weeks from today and on doing so, experience certificate be issued to them within a period of two weeks thereafter.” MEHAK HURIA 2025.04.09 15:42 I attest to the accuracy and integrity of this order/judgment COCP-3175-2023 2 2. Learned counsel appearing for respondent No.2 has submitted that the in terms of the said judgment, one Subhash Chand and thereafter, 19 more persons have filed applications and accordingly, experience certificates, as per the record, have been issued to the concerned workmen. It is further submitted that no other application has been moved by the workmen. Learned counsel for the respondent No.2 has however fairly submitted that in case, any other person out of the petitioner’s association moves an application even now within a period of two weeks then also the experience certificate would be released to him/her. 3. In view of the abovesaid stand, Rule is discharged and the present contempt petition is disposed of. 4. Liberty is granted to the employees who are part of the petitioner’s association to apply for experience certificate within a period of two weeks from today and in case of their doing so, the experience certificate regarding the same be released by respondent No.2-University, in accordance with law.
