Heard learned counsel for the petitioner and the learned Standing Counsel for the respondents. The petitioner is seeking a direction to the respondents to grant pension and pensionary benefits, arrears e.t.c. in accordance with law along with 12% interest on delayed payment to the petitioner. Learned counsel for the petitioner submits that petitioner has moved representation before the competent authority, for redressal of his grievance, but nothing has been done till date. Therefore, a direction may be issued to the respondent no.3 to take decision on the representation and pass appropriate orders in accordance with law. Learned counsel for the respondent-BSA submits that he has no objection in case a fresh representation is moved by the petitioner before the competent authority, the same will be considered and decided in accordance with law. Considering the facts and circumstance of the case but without expressing any opinion on the merits of the case set up on behalf of the petitioner, the present writ petition is disposed of by providing that petitioner may make fresh application/representation, ventilating all his grievances, supported by such documents, as may be advised, before the respondent no.3 Commissioner/Director (Industry), Karmik Anubhag-3(A), U.P. at Kanpur, within three weeks from today along with a certified copy of this order. On such representation being made, respondent no.3 shall make all Versus Counsel for Petitioner(s) : Udai Prakash Deo Pandey Counsel for Respondent(s) : C.S.C. Sumitra Devi .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) endeavours to consider and decide the same, strictly in accordance with law, by means of a reasoned and speaking order, after giving proper opportunity of hearing to the parties concerned, as expeditiously as possible, preferably within a period of six weeks from the date of production of certified copy of this order, if there is no legal impediment.
