Further, statement of the victim was got recorded under Section 164 Cr.P.C., as per which no offence was made out against the petitioner, and on that basis even a cancellation report was prepared. However, the matter was ordered to be reinvestigated, leading to the false implication of the present petitioner. The final report under Section 173 Cr.P.C. was presented before the concerned Court and trial of the case has not made much progress, as charges were framed on 23.10.2024 and out of total of 25 prosecution witnesses, none has been examined. No useful purpose shall be served by further detention of the accused/petitioner.
