Learned counsel for the petitioner is not pressing this civil revision petition filed under Article 227 of the Constitution of India in view of the latest decision rendered by the Hon’ble Supreme Court in the case of P.Suresh Vs. D.Kalaivani & Ors. reported in 2026 SCC OnLine SC 143. As per the aforesaid decision of the Hon’ble Supreme Court, it has been made clear that when an alternate remedy is available to the petitioner under the CPC by filing an application under Order VII Rule 11 CPC, the party cannot approach the High Court by filing a civil revision petition under Article 227 of the Constitution of India to strike off the plaint filed in a suit. 3.
