There is no dispute about the fact that proceeding under Section 9 of Hindu Marriage Act initiated at the instance of the opposite party-wife is pending in the Court of Principal Judge Family Court, Mahoba. 6. The perusal of the averments made in the affidavit filed in support of the transfer application as well as the averment made in the petition under Section 9 of Hindu Marriage Act demonstrate that there is no grounds for transfer of the proceeding initiated by opposite party-wife under Section 9 of the Hindu Marriage Act from District Mahoba to any other adjacent district as opposite party-wife is residing in her mayaka at Mahoba. 7. Considering the entire facts and circumstances of the case, no interference is required in the matter. 8. The instant transfer application is dismissed.
