Learned counsel for the petitioner submitted that due to inadvertence the learned counsel for the petitioner could not appear on 25.02.2025 and as such the case was dismissed for non- prosecution. However, the absence of learned counsel for the petitioner was neither intentional nor deliberate, but it was due to unavoidable circumstances which were beyond the petitioner’s control. It is submitted that the petitioner will remain careful in future and hence, Cr. Revision No.197 of 2016 may be restored. 3. Learned APP has raised no objection. 4. Having heard learned counsel for the petitioner and the learned APP for the State and in view of the averments made in paragraph nos.5 to 9 of the instant application, the instant Cr. M.P. No.761 of 2025 is allowed and Cr. Revision No.197 of 2016 is restored to its original file, subject to the payment of Rs.1000/- in the Jharkhand High Court Advocate’s Clerk Association Welfare Fund within 15 days from today and shall file receipt in the records of Cr.
