Also heard Shri N Upadhyay, learned Standing Counsel, Irrigation Department, Assam as well as Shri A Chaliha, learned Standing Counsel, Finance Department, Assam. The matter pertains to the pensionary benefit of the petitioner who had retired as a Helper. Shri Upadhyay, learned Standing Counsel, Finance Department has, however, submitted that immediately after the institution of the writ proceeding, the matter was settled. He has in fact placed before this Court copy of the PPO which was issued on 24.08.2022 itself. The said PPO also includes the communication of the same date to the Treasury Officer, Goalpara regarding the onward action. Though Shri MA Sheikh, learned counsel for the petitioner submits that he does not have the instructions of the said development, noticing the aforesaid development, this Court is of the view that there is no reason to keep this writ petition pending.
