Heard learned counsel for the petitioner, Mr. Jitendra Ojha, learned counsel for the respondent no.1, Mr. Tarun Agrawal, learned counsel for respondent no.2 as well as learned Standing Counsel for the State- respondent nos.3 and 4. The present petition has been filed with the prayer to direct the respondent no.4 to change/modify the petitioner's duty as B.L.O. for one booth only and a further prayer to direct the respondent no.4 to decide the representation dated 18.08.2025, forthwith. Learned counsel for the petitioner submits that the petitioner who is 60 years old has been deputed as B.L.O. at three places which is not in consonance with the guidelines as issued by the Election Commission as well as the direction issued by Co-ordinate Bench of this Court in the case of Surya Pratap Singh vs. State of U.P. and Others (Writ-A No.16401 of 2024) decided on 11.02.2025. He further submits that the petitioner has represented before the respondent no.4 by means of filing application/representation but nothing has been done till date. Learned counsel for the State as well as learned counsels for the respondents could not dispute the aforesaid fact and submit that the case of the petitioner shall be considered at the earliest, in accordance with law. In view of the above, without expressing any opinion on the merits of the Versus Counsel for Petitioner(s) : Arvind Srivastava, Vikrant Gupta Counsel for Respondent(s) : C.S.C., Jitendra Ojha, Tarun Agrawal Rashid Ali Khan .....Petitioner(s) Election Commission Of India Nirwachan Sadan New Delhi And 3 Others .....Respondent(s) case set up on behalf of the petitioner, the present writ petition is disposed of with a direction to respondent no.4-Assistant Election Officer/Sub-Divisional Magistrate, Tehsil- Puwaya, District- Shahjahanpur to make all endeavours to consider and decide the aforesaid application/representation of the petitioner, by means of a reasoned and speaking order, after giving proper opportunity of hearing to the petitioner, as expeditiously as possible, within a period of two weeks from today, strictly in accordance with law, keeping in mind the guidelines as well as observations as made by the Court in the case of Surya Pratap Singh (supra), if there is no legal impediment.
