Ms. Manisha Rana Singh, D.A.G. for the State. Hon’ble Ravindra Maithani, J. (Oral) Applicant is in judicial custody in FIR No.235 of 2020, under Sections 302 and 120-B IPC, Police Station Kelakhera, District Udham Singh Nagar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused. 3. This is the third bail application. The first bail application, being BA1 No.2188 of 2021, was rejected on 24.09.2022. The second bail application, being BA2 No.81 of 2024, was rejected on 21.03.2024. 4. Learned counsel for the applicant submits that on the ground of delay, co-accused has already been granted bail; the role of the applicant is similar insofar as period of incarceration is concerned. 2 5. Learned State Counsel admits this fact. 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
