Heard learned counsel for the petitioners, learned Standing Counsel for respondent no.1 and Sri Shyam Mani Shukla, learned counsel for respondent nos.2 & 3. 2. The petitioners by means of the present writ petition have prayed for the following relief:- "i. Issue a writ, order or direction in the nature of mandamus directing the respondent authorities not to demolish the House Nos.D.T.C.-1827, DT-C-1824, DT-C-1821, DT- C-1828, DT-C-1825, DT-C-1822, DT-C-1826 and DT-C-1823 which belongs to respective petitioner nos.1 to 9 situate at Delapur Talab, Awas Vikas Bareilly. ii. Issue a writ, order or direction in the nature of mandamus directing the respondent no.1 to decide the representation dated 4th of June, 2025 jointly made by petitioners. iii. Issue any other suitable writ, order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case. iv. Award the cost of this writ petition in favour of petitioners." 3. Sri Shyam Mani Shukla, learned counsel for respondent nos.2 & 3 on instruction submits that as on today, no proceeding of demolition against the petitioners is being undertaken, therefore, apprehension of the petitioners is misconceived. 4. In view of the aforesaid statement of Sri Shyam Mani Shukla, learned counsel for respondent nos.2 & 3, the writ petition is dismissed. However, in case any demolition proceeding is initiated against the petitioners, it is Versus Counsel for Petitioner(s) : Rakesh Kumar Mishra Counsel for Respondent(s) : C.S.C., Shyam Mani Shukla Naresh Kashyap And 8 Others .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) expected from the respondent-authority to initiate the demolition proceedings strictly in accordance with law.
