The petitioner has been made accused in connection with Birni P.S. Case No. 124 of 2023, S.T. Case No.553 of 2023, for the offence registered under Sections 302/34 of the Indian Penal Code and cognizance taken under Sections 304/34 of the Indian Penal Code, pending in the court of learned Principal District & Sessions Judge, Giridih. Bail application of the petitioner was earlier rejected by this Court vide B.A. No. 4705 of 2024 by order dated 13.09.2024. On 18.06.2023, petitioner and co-accused persons are alleged to have assaulted the son of the informant, due to which, he succumbed to his injuries. While rejecting the bail application of the petitioner, liberty was given that if the trial is not concluded within six months from the next date fixed for recording of evidence, if so advised, he may renew his prayer for bail. Learned senior counsel for the petitioner has submitted that there is general and omnibus allegation against the accused persons. It was further submitted that co-accused Malwa Devi has been granted bail by this Court earlier. -2- Mr. Prashant Kumar Rai, learned counsel for the informant has vehemently opposed the prayer for bail and submitted that the case is fixed for recording of statement under Section 313 of the Cr.P.C. Considering the nature of allegation and the fact that one of the similarly situated co-accused has been granted bail, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Principal District & Sessions Judge, Giridih, in connection with Birni P.S.
