JUSTICE PRAVEER BHATNAGAR Order 04/03/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.06/2025 registered at Police Station Taleda, District Bundi for the offence(s) under Sections 189(2), 126(2), 115(2), 109(1) and 333 of BNS. Learned counsel for the petitioners submits that the accused- petitioners have falsely been implicated in this case. It is argued that the injuries sustained to injured Pritam and Ram Prasad were not opined to be dangerous to life. The injuries sustained to Pritam were found to be simple blunt in nature and injuries sustained to injured Ram Prasad at his left wrist was found to be grievous in nature. Prima facie case under Section 109(1) of BNS is not made out against the petitioners. Similarly placed co- [2025:RJ-JP:9445] (2 of 3) [CRLMB-3115/2025] accused Premshankar has already been enlarged on bail vide order dated 03.02.2025. The accused petitioners are in custody since 19.02.2025 and the trial/investigation of the case will take considerable time. Therefore, the benefit of bail may be granted to the accused-petitioners. Per contra, learned Public Prosecutor opposes the bail application. Considering the arguments advanced by the counsel for the parties and looking to the fact that injuries sustained to injured Ram Prasad and Pritam were not dangerous to life and similarly placed co-accused Premshankar has already been enlarged on bail vide order dated 03.02.2025. The accused petitioners are in custody since 19.02.2025, the trial/investigation of the case will take considerable time, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioners on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners 1. Mohan Lal Alias Morphal S/o Mannalal, 2. Bheru Singh S/o Mohanlal @ Morphal, in connection with FIR No. 06/2025 registered at Police Station Taleda, District Bundi shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
