Neutral Citation No. - 2025:AHC:29252 Court No. - 37 Case :- WRIT - C No. - 29728 of 2024 Petitioner :- Jeet Bahadur And 2 Others Respondent :- State Of Up And 5 Others Counsel for Petitioner :- Amar Singh Yadav Counsel for Respondent :- Bhupendra Kumar Tripathi,C.S.C. Hon'ble Syed Qamar Hasan Rizvi,J.
1. Heard Sri Amar Singh Yadav, learned counsel for the petitioners, Sri Vijay Pratap Singh, learned Additional Chief Standing Counsel for the State-respondents and Sri Bhupendra Kumar Tripathi, learned counsel appearing on behalf of the Gaon Sabha.
2. By means of the present writ petition the petitioners have prayed for the following relief:
"(a) Issue a writ order or direction in the nature of mandamus directing the respondent no. 2 - Sub Divisional Magistrate, Tehsil Sahaganj, District Jaunpur to decide the application dated 01.08.2024 filed by the petitioners in Case No. 959 of 2024 (Computerized No. C202414360100959) (Jeet Bahadur Vs. Gram Panchayat & others) under Section 116 of U.P. Revenue Code, 2006, expeditiously or within the stipulated period as may be fixed by this Hon'ble Court."
3. Learned counsel appearing on behalf of the Gaon Sabha, on the basis instructions, received by him from the respondent no. 5, made a statement that an appeal against the order dated 7.6.2024 has been filed and is pending before the court of Additional Commissioner (Judicial-I), Varanasi Division, Varanasi. He further submits that the said appeal has been registered as Appeal No. 1590/2024 (Rajesh Vs Jeet Bahadur). Thus after filing of the statutory appeal the application dated 01.08.2024 has become redundant and as such the relief prayed for in the instant writ petition are of no avail to the petitioners.
4. In view of the aforesaid statement, learned counsel for the petitioners prays that he may be permitted to withdraw the present writ petition at this stage.
5. The writ petition is accordingly dismissed as withdrawn. Order Date :- 3.3.2025 Arif Digitally signed by :- MOHAMMAD ARIF High Court of Judicature at Allahabad
