ORDER:
The instant Writ Petition is filed by the Petitioners seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief:
“....to issue appropriate writ or order or direction more particularly one in the nature of writ of mandamus declaring the action of the 2nd and 3rd respondents in calling the petitioners to the police station and threatening the petitioner to pay cheque amount of Rs.7 lakhs to the 4th respondent or to execute promissory notes in favour of 4th respondent is illegal, arbitrary and in violation of Principles of Natural justice and in violation of Art.14 of the Constitution of India and consequently direct the respondents No.2 and 3 not to call the petitioners to the police station in respect of Civil Dispute in the 4th respondent particularly relating to the chit activities in the interest of justice and to pass ...”
Learned Assistant Government Pleader for Home on written instructions would submit that there are civil disputes pending between the Petitioners and respondent No.4 relating to money transaction and that respondent never interfered in their civil disputes and never called the Petitioners to the Police Station and that to prevent the Police from taking any action in the event of lodging of any complaint by respondent No.4 against the Petitioners in future, the present Writ Petition came to be filed and would submit that this Court may pass appropriate orders by disposing of this Writ Petition. None represented for the Petitioners. 3
In the light of the submissions made, this Writ Petition is disposed of. Respondent Police are directed not to interfere in the civil disputes pending between the parties except following due process of law. No order as to costs.
