1. Heard learned counsel for the revisionist, learned A.G.A for the State and perused the material on record.
2. Despite service of notice upon opposite party no.2, no one has appeared on his behalf, even in the revised call.
3. The present revision has been filed against the order dated 29.07.2024 by which the application of the revisionist filed under Section 156(3) Cr.P.C. has been dismissed on the ground that the court of Special Judge, (SC/ST) Act, Bareilly has no jurisdiction to entertain such application, for the reason that the allegations made in the said application against the opposite party no. 2 are covered under relevant sections of Anti Corruption Act and, therefore, the court of Special Judge (SC/ST) Act, has no jurisdiction to entertain and tried in such offences.
4. However, the revisionist prays to file revision against the order dated 29.07.2024, since the alternate remedy is available to the revisionist to approach before the competent court having jurisdiction to trial the cases under Anti Corruption Act. No other prayer has been sought in this revision. Hence, it is still open to the revisionist to seek appropriate remedy before the appropriate forum.
