The present applicant ‘Sanamdeep’ S/o Gurpal Singh is praying for bail in relation to First Information Report dated 20.01.2025 bearing FIR No. 42 of 2025 P.S. Sitarganj, District Udham Singh Nagar, which was lodged against the unknown person for the offence punishable under Section 309(2) of BNS, 2023. 4. It is submitted by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and furthermore on completion of investigation the charge-sheet has been filed and the present applicant and the other one Sanchit Kashyap have been chargesheeted for the offences punishable under Sections 3(5), 309(2) and 317(2) of BNS, 2023. 5. Learned counsel for the applicant submits that the recovery as shown is planted one since there is no any independent witness of the recovery and furthermore the applicant is not named in the FIR. He submits that the applicant has no criminal antecedents and since the charge- sheet has been filed as such there is no need of custodial interrogation of the present applicant. 6. He further submits that the another co- accused is already been enlarged on bail by this court on 08.07.2025 in Bail Application No. 529 of 2025 and, therefore, the applicant deserves for parity. 7. On the other side, learned Additional Advocate General Mrs. Pushpa Bhatt submits that after collecting all credible evidences the charge- sheet has been filed and there is also recovery from the present applicant, however, she has not disputed that the other co-accused has already been enlarged on bail by this court and 2025:UHC:6530 furthermore the applicant has no previous criminal history. 8. After hearing the arguments of learned counsel for the parties and further taking into consideration that the charge-sheet has already been filed and furthermore another co-accused Sanchit Kashyap has already been enlarged on bail, therefore, this court is of the view that the applicant deserves for bail. 9. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 10. Let the applicant ‘Sanamdeep’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
