1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. 2. This application for grant of anticipatory bail arises out of Excise Complaint Case No. 250C-2 of 2018, dated 07.09.2018, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2018 (hereinafter referred to as ‘the Act’). 3. The prosecution case, as per the First Information Report, is that during patrolling duty the police got secret information of transportation of illicit liquor and reached near Janipur Dhala. Patna High Court CR. MISC. No.85811 of 2025(2) dt.18-12-2025 2/3 that one truck, bearing registration no. RJ04-GA- 0911, one Mahindra Pick-up van, bearing registration no. BR09-M-2785 and two Magic van without registration was parked near Janipur Dhala. On search, total 4007.52 liters of illicit liquor has been recovered from the seized vehicles. 4. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has been implicated in the present case merely on the basis of suspicion. He next submits that the petitioner has no concern with the illicit liquor and/or with the seized vehicle and nothing has been recovered from conscious possession of the petitioner and/or from the vehicle belonging to him. He further submits that the name of petitioner has transpired in the present case only on the basis of criminal antecedents in which he is on bail. Learned counsel also submits that similarly situated co- accused persons have been grated anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. Patna High Court CR. MISC. No.85811 of 2025(2) dt.18-12-2025 3/3 No. 29538 of 2021, Cr. Misc. No. 23882 of 2021 and Cr. Misc. no. 22275 of 2021. 5.
Regards being had to the submission made by the parties and taking into consideration the fact that the petitioner has approached this Court after a delay of about more than five years from the date of lodging of the FIR and he has six criminal antecedents of similar nature, I am not inclined to grant the petitioner privilege of anticipatory bail. 6.
