learned counsel for the applicant.

3. Present applicant Suraj Pandey, S/o Shri Ghanshyam Pandey is praying for bail in relation to FIR dated 05.03.2025, bearing FIR No. 72 of 2025 registered at P.S. Transit Camp, District Udham Singh Nagar wherein the present applicant along with two other co-accused, namely, Boby Chaudhary and Jai Prakash were implicated and charge sheeted for the offences punishable under Section 109, 351(2), 3(5) of BNS 2023 read with Section 3/25 of Arms Act.

Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated and furthermore, the charge sheet has already filed, and, as such there is no need of custodial interrogation of the applicant. He further submits that other two co-accused have already been enlarged on bail. He further argued that the applicant is languishing in jail since 12.03.2025. Apart from this, he argued that the even as per the medical report, injuries sustained by the injured are not grievous in nature.
5. On the other side, Mr. Sharma, learned A.G.A. has not disputed this fact that charge sheet has already been filed, and, as such, there is no need of custodial interrogation of the applicant and he has also not disputed this fact that other two co-accused have already been enlarged on bail.
6. After hearing the arguments of the
learned counsel for the parties and taking
2025:UHC:8624 into consideration that charge sheet has already been filed and other two co- accused have already been enlarged on bail, this Court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
8. Let the applicant “Suraj Pandey” be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
