Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the record. The present petition has been filed for the following reliefs:- "1. यह िक सम्माननीय न्यायालय उत्प्रेषण प्रकृ ित के यािचकादेश, आदेश, िनदेर्श के माध्यम से आरोिपत अपराध संख्या 0123 वषर् 2025 अन्तगर्त धारा 87 भारतीय न्याय संिहता (बी एन एस) 2023 थाना औद्योिगक क्षेत्र, जनपद प्रयागराज की प्राथिमकी िदनाँिकत 17.07.2025 (संलग्नक संख्या 1) समेत उसके आधार पर कृ त अन्यान्य समस्त आद्योपान्त कायर्वाही िनरस्त/अपास्त /िवखिण्डत / रद्द करने की कृ पा करें। 2. यह िक सम्माननीय न्यायालय परमादेश प्रकृ ित के यािचकादेश, आदेश, िनदेर्श के माध्यम से आरोिपत अपराध संख्या 0123 वषर् 2025 अन्तगर्त धारा अन्तगर्त धारा 87 भारतीय न्याय संिहता (बी एन एस) 2023, थाना औद्योिगक क्षेत्र • जनपद प्रयागराज की प्राथिमकी िदनोंिकत 17.07.2025 को िक्रयािन्वत करने, प्रभावी रखने व उसके आधार पर याची के िवरूद्ध कोई प्रपीड़क/कठोर कायर्वाही करने व उसे िगरफ्तार करने से उत्तरवादीगण समेत उनके सहयोगी सहकमीर् अधीनस्थ सम्बिन्धत अन्यान्य समस्त अिधकारीगण, कमर्चारीगण को िनषेिधत, िनिषिद्धत/मना करने की महती कृ पा करें। " It has been brought to our notice that the first information report challenged in the present petition was also challenged by the main accused Lal Babu through Criminal Misc. Writ Petition No. 16872 of 2025 and this Court vide its order dated 12.08.2025 passed in the writ petition, stayed the arrest of the petitioners. It would be appropriate in the interest of justice that the petitioner be also granted the same protection as previously granted to the co-accused by the Versus Counsel for Petitioner(s) : Narendra Shanker, Sanjay Pathak Counsel for Respondent(s) : G.A. Laxman Yadav .....Petitioner(s) Rajya Uttar Pradesh And 3 Others .....Respondent(s) coordinate Bench of this Court by the aforesaid order dated 12.08.2025. In the circumstances of the case and after considering the rival arguments of the counsel for the parties, the writ petition is disposed of with a direction that the petitioner shall not be arrested in pursuance to the first information report dated 17.07.2025 registered in Case Crime No. 0123 of 2025, Under Section-87 B.N.S., Police Station- Audyogik Kshetra, District-Prayagraj till submission of the police report under Section 193 of BNSS, 2023.
