2023. 3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on 09.07.2025, he was sleeping at Makhtab at 11:00
Patna High Court CR. MISC. No.79798 of 2025(2) dt.08-12-2025 2/3 p.m. where he works as a Guard, further, 7 named accused persons including the petitioners came and asked him to open the gate of the Makhtab for consuming Ganja, on objection, they abused but villagers gathered and pacified the issue, further, on 10.07.2025 at 06:00 a.m., he had come to a tea shop for having tea when aforesaid 7 named accused persons including the petitioners along with Ramu Paswan and 15-20 unknown accused came and started assaulting him, on alarm, his 3 co- villagers came to save him but accused persons assaulted them also causing injury. 4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant.
It is next submitted that from perusal of the allegations, as alleged in the FIR, it would manifest that allegation of assault is general and omnibus in nature. It is asserted and submitted that petitioners are not criminals. 5. Learned APP for the State opposes the anticipatory bail application. 6. Considering the submissions made by the learned counsel for the petitioners, let petitioners, above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on
