Learned counsel for the appellant submits that this Arbitration Appeal arises out of judgment dated 04.12.2021, passed by the learned District Judge, Mandi, District Mandi, H.P. in a bunch of matters pertaining to Mohal Jarol, Tehsil Sundernagar, District Mandi with lead case Arbitration Petition No. 107 of 2018 (NHAI Vs. Husan Lal). It was submitted that Arbitration Appeal No. 112 of 2024, arising out of Arbitration Petition No. 107 of 2018 has been decided on 17.10.2024. That the aforesaid judgment and findings therein will mutatis mutandis apply to the facts of instant Arbitration Appeal arising out of Arbitration Petition No. 110 of 2018 which was part of bunch of Arbitration Petitions decided by learned District Judge Mandi, H.Pl vide judgment dated 04.12.2021. 1 Whether reporters of Local Papers may be allowed to see the judgment? YES 2 02. In view of above submission, this appeal is also decided in terms of judgment dated 17.10.2024, rendered in Arbitration Appeal No.112 of 2024 (NHAI Vs. Husan Lal) and connected matters, supra. The decision therein shall mutatis mutandis apply to the present appeal. Consequently, the present appeal is dismissed and the award passed by the learned Arbitrator is affirmed. Pending miscellaneous application(s), if any, also to sand disposed of.
