IN THE HIGH COURT OF ORISSA AT CUTTACK
BLAPL No.532 of 2025
Gedu @ Ajaya Kumar Rout
…. Petitioner Mr. Anup Udaya Senapati, Advocate
-versus- State of Odisha
…. Opp. Party Mr.Satyabrata Panda, ASC
CORAM:
JUSTICE SIBO SANKAR MISHRA
Order No.
ORDER 04.02.2025
01.
1. Earlier, the bail application of the petitioner was rejected vide order dated 01.08.2024 in BLAPL No.13601 of 2023. However, liberty was granted to the petitioner to renew his bail plea after examination of the wife of the deceased. It was also observed by the said order that the trial Court shall do well to see that the said witness is examined within three months.
2.
Learned counsel for the petitioner submits that, even after expiry of three months, the wife of the deceased has not yet been examined. Hence, he has repeated the bail plea. However, nothing is emanating
from the record as to why the said witness has not been examined as yet.
3. Be that as it may, I am not inclined to enlarge the present petitioner on bail at this stage before examination of the wife of the deceased, because of the gravity of the offences alleged against the petitioner.
4. Accordingly, it is directed that the learned trial Court shall do well to see that, the said witness is examined preferentially over all other witnesses. Thereafter, the petitioner shall renew his bail plea.
5. With the aforementioned observation, the BLAPL is disposed of.
