(Oral) By way of instant petition, petitioner has prayed for following main reliefs: “(I) That the respondents may kindly be directed to pay the arrears of salary w.e.f. 01.01.2016 to 31.12.2020 with interest @ 12% per annum from the due date till the date of its realization. (II) That the respondents may kindly be directed to pay the revised Gratuity amounting to Rs. 2,38,160/- with interest @ 12% per annum from the due date till the date of its realization. (III) That the respondents may kindly be directed to pay the Leave encashment on revised rate w.e.f. 01.01.2016 to 28.02.2019 with interest @ 12% per annum from the due date till the date of its realization. (IV) That the respondents may kindly be directed to pay the DA arrear for the year 2021-22.” 2. In this writ petition, the petitioner, who has retired from the services of respondent-Corporation, is seeking arrears of revision of pay scale w.e.f. 01.01.2016 to 31.12.2020 with interest @ 12% per annum from the respective date till the date of realization. He is also 2025:HHC:4921 2 seeking direction to the respondents to revise the gratuity & leave encashment and to pay it alongwith interest @ 12% per annum w.e.f. 01.01.2016 till the date of its realization, in view of the judgment dated 17.07.2014, passed by Coordinate Bench of this Court in CWP No.3050 of 2014 Nek Ram vs. State of H.P. & others. 3. Learned proxy counsel for the parties are ad idem that this Court has already granted similar relief to similarly placed persons in CWP No.2108 of 2023, decided on 31.05.2023 and in CWP No.2421 of 2023, decided on 15.06.2023. 4. In view of aforesaid, writ petition is allowed. Respondents are directed to pay arrears of pay revision w.e.f. 01.01.2016 to 31.12.2020 with interest @ 6% per annum from due date till the date of its realization and they shall also revise the gratuity & leave encashment and pay the same alongwith interest @ 6% per annum to the petitioner w.e.f. 01.01.2016 till the date of its realization.
