PUBLIC PROSECUTOR The Court made the following Order: The petitioners are arraigned as Accused Nos.4 and 5 in Crime No.17 of 2025, on the file of Yemmiganur Rural Police Station, Kurnool. 2. The petitioners are alleged to have committed offences under Sections 85 of the Bharatiya Nyaya Sanhita Act, 2023 (for short ‘BNS Act’) and Sections 3 and 4 of the Dowry Prohibition Act, 1961 read with Section 3(5) of the BNS Act. 3. The petitioners are the maternal uncles of the accused No.1. The marital disputes between the accused No.1 and the 2 respondent No.2 resulted in filing of a complaint before the Yemmiganur Rural Police Station, by the respondent No.2. 4. The learned counsel for the petitioners further submits that the petitioner No.1 is residing in Hyderabad and the respondent No.2 is residing in Pune. It is also submitted that the petitioners have absolutely no role in the commission of the alleged offence and that they have not interfered in the marital disputes between the accused No.1 and respondent No.2. 5. The learned Assistant Public Prosecutor submits that the case is still at the investigation stage and that the FIR was registered only on 04.02.2025. 6. Considering the same, the Station House Officer/Investigating Officer, of Yemmiganur Rural Police Station, Kurnool, shall follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita Act, 2024 (for short ‘BNSS Act’), insofar as the petitioners are concerned. 7. With these observations, the criminal petition is disposed off.
