Mr. V.P. Bahuguna, Advocate for the petitioner. Mr. Saurav Adhikari, Advocate for the respondent nos. 1 and 2. Mr. V.K. Kaparuwan, Advocate for the respondent no.3. By means of the instant petition, the petitioner seeks the following reliefs:- (i) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to consider the candidature of the petitioner for promotion/appointment to the post of Junior Assistant (Junior Clerk) at Cantonment Board, Lansdowne in terms of letter dated 22.01.2025 (annexed as Annexure No.12 to this writ petition) of the respondent no.3 and in terms of provisions of Rule 5(3) of the Service Rules, 2021. (ii) Issue a writ order or direction in the nature of mandamus commanding and directing the respondent to consider the representation of the petitioner with giving opportunity of hearing for petitioner to be considered for promotion/absorption to the post of Junior Clerk in Cantonment Board, Lansdowne. (iii) Issue any other order or direction which this Hon’ble Court may deem fit and proper in the circumstances of the case. (iv) Award cost of the petition.
Learned counsel for the petitioner submits that the case of petitioner is identical to co-worker Naveen Chandra Pant,
who had been appointed on the position of clerk. He was also earlier working in Group 4 services, like the petitioner, but the claim of the petitioner has not been considered by the respondent no.2, Principal Director, Directorate of Defence, despite a recommendation having been made by the respondent no.3, Chief Executive Officer (“the C.E.O”) on 22.01.2025, a copy of which is Annexure No.12 to the writ petition. He submits that the respondent no.2, Principal Director, Directorate of Defence, may be
directed to take a decision on the communication dated 22.01.2025 (Annexure No.12 to the writ petition) of the respondent no.3/the C.E.O within a stipulated time, by a reasoned and speaking order.
Learned counsel for the respondent nos. 1 and 2 submits that a decision shall be taken on the communication dated 22.01.2025 of the respondent no.3/the C.E.O., Annexure No.12 to the writ petition, within a period of four weeks. The Court takes on record the statement given by learned counsel for the respondent nos. 1 and 2. The writ petition is disposed of with the direction to the respondent no.2, Principal Director, Directorate of Defence, to decide the representation of the petitioner dated 22.01.2025, which is Annexure No.12 to the writ petition, within a period of four weeks from today, with a reasoned and speaking
order, and if required, an opportunity of hearing may be afforded to the petitioner.
