State counsel opposes the bail on the ground that second ancipatory bail applicaon is not maintainable because the first was decided on merits. 3. A;er arguing at length, counsel for the peoner submits that he be permi<ed to withdraw the present peon with liberty to surrender before trial Court within a week. In case of his surrender, trial Court be directed to decide his applicaon for bail within three days. Counsel for the peoner further submits that in another case, peoner was brutally tortured and as such, if Magistrate intends to send him to police remand, it should be subject to strict medical examinaon for the enre period of police remand. 4. However, State counsel submits that at least five days should be given to the Magistrate to decide the bail peon because three days are too less. It is further clarified that in case, peoner is sent on police remand, he shall be subjected to medical examinaon and cerficaon. All pending miscellaneous applicaons, if any, stand disposed of.
