Petitioner herein, who, at present is working as TGT (Medical) at Govt. High School Shali u/c Govt. Senior Secondary School Aura, Tehsil Bharmour, District Chamba Himachal Pradesh, has approached this Court in the instant proceedings, praying therein to issue directions to the respondents to consider and decide her representation dated 21.9.2024 (Annexure P-1), in a time bound manner, whereby she has prayed for transfer from hard area to soft area or one of the stations of her choice after her having completed normal tenure in the tribal area. - 2 -

Having regard to the nature of prayer and order proposed to be passed, this court sees no necessity to call for reply from the respondents, who are otherwise represented by Mr. Rajan Kahol, learned Additional Advocate General. While putting in appearance on behalf of the respondents, Mr. Rajan Kahol, learned Additional Advocate General, states that representation, if not already decided, shall be decided expeditiously. 3. Perusal of averments contained in the petition as well as documents annexed therewith reveals that petitioner was appointed as TGT (Medical) in the month of February 2022 and since then, she is posted at GHS Shali. Since petitioner has already completed her normal tenure at the present place of posting i.e. two winters and three summers in the hard area, she is entitled to be transferred to soft area or one of the stations of her choice in terms of the transfer policy and as such, there appears to be no impediment in issuing direction as sought for. 4. Consequently, in view of the above, this Court without going into the merits of the case deems it fit to dispose of the present petition with a direction to the respondents to consider and decide the pending representation of the petitioner expeditiously, preferably within a period of two weeks. Ordered accordingly.
Needless to say, authority concerned, while affording opportunity of hearing to the petitioner shall also take note of the transfer policy formulated by the
- 3 - Government of Himachal Pradesh, which provides for transfer of an employee from hard area to soft area after his/her having completed normal tenure at present place of posting and pass appropriate orders. Pending applications, if any, also stand disposed of. March 18, 2025
